Furthermore, it specifies that inventions, utility models and new plant varieties are subject to patenting, while trademarks, designs, models and topographies of semiconductor products are subject to registration. Article 2 also establishes that distinctive marks other than registered trademarks, confidential company information, geographic indications and denominations of origin are protected where provided for by the law. The exclusive rights enjoyed via patenting and registration are granted by the Italian Patents and Trademarks Office upon application by the person concerned and after verifying that all legal requirements are fulfilled. The document, which is a patent or registration depending on the case, is an administrative act with a double purpose: declaratory, as it presupposes that a series of requirements are met, and constitutive, as it attributes new rights to the holder.
